ABOUT THE SPEAKER
Scott Fraser - Forensic psychologist, expert witness
Scott Fraser is a forensic psychologist who thinks deeply about the fallibility of human memory and encourages a more scientific approach to trial evidence.

Why you should listen

When it comes to witnesses in criminal trials, the accuracy of human memory can mean the difference between life and death. Scott Fraser is an expert witness who researches what’s real and what’s selective when it comes to human memory and crime. His areas of expertise include human night vision, neuropsychopharmacology, and the effect of stress and other factors on the human mind. He has testified in criminal and civil cases throughout the U.S. in state and federal courts.

In 2011 Fraser was involved in the retrial of a 1992 murder case in which Francisco Carrillo was found guilty and sentenced to two life sentences in prison. Fraser and the team that hired him staged a dramatic reenactment of the night of the murder in question and showed the testimonies that had put Carrillo in jail were unreliable. After 20 years in jail for a crime he didn't commit, Carrillo was freed.

Scott Fraser: Why eyewitnesses get it wrong

of the nature of evidence preservation

02:41
So at the actual trial,
43
145202
2906
Então, no julgamento real,
02:44
all six of the teenagers testified,
44
148108
3000
todos os seis adolescentes testemunharam
02:47
and indicated the identifications they had made

02:50
in the photo array.

02:54
He was convicted. He was sentenced to life imprisonment,

Ele foi condenado. Foi sentenciado à prisão perpétua

and transported to Folsom Prison.

03:04
So what's wrong?
49
168582
2089
Então, o que está errado?
03:06
Straightforward, fair trial, full investigation.
50
170671
4766
Julgamento justo, investigação completa.
03:11
Oh yes, no gun was ever found.
51
175437
3541
Ah... sim, nenhuma arma foi encontrada.
03:14
No vehicle was ever identified as being the one
52
178978
4154
Nenhum veículo foi identificado como sendo aquele
03:19
in which the shooter had extended his arm,
53
183132
3224
no qual o atirador tinha estendido seu braço,
03:22
and no person was ever charged with being the driver
54
186356
3285
03:25
of the shooter's vehicle.
55
189641
3242
do veículo do atirador.
03:28
And Mr. Carrillo's alibi?
56
192883
3881
E o álíbi do Sr. Carrillo?
03:32
Which of those parents here in the room might not lie
57

03:37
concerning the whereabouts of your son or daughter

03:40
in an investigation of a killing?
59
204877
3897
numa investigação de assassinato?
03:46
Sent to prison,
60
210874
2722
Mandado à prisão,
03:49
adamantly insisting on his innocence,
61
213596
3498
ele insistiu inflexivelmente em sua inocência,
03:52
which he has consistently for 21 years.
62
217094
4737
por 21 anos.
03:57
So what's the problem?
63
221831
3471
Então, qual é o problema?
04:01
The problems, actually, for this kind of case
64
225302
2724
04:03
come manyfold from decades of scientific research
65
228026
3909
vêm, muitas vezes, de décadas de pesquisas científicas
04:07
involving human memory.
66
231935
3902
envolvendo a memória humana.
04:11
First of all, we have all the statistical analyses
67
235837
2814
Primeiramente, temos todas as análises estatísticas
04:14
from the Innocence Project work,
68
238651
2207
do trabalho do Projeto Inocência,
04:16
where we know that we have, what,
69
240858
2697
onde temos cerca de
04:19
250, 280 documented cases now where people have
70
243555
3781
250, 280 casos documentados de pessoas
04:23
been wrongfully convicted and subsequently exonerated,
71
247336
4072
que foram erroneamente condenadas e depois absolvidas,
04:27
some from death row, on the basis of later DNA analysis,
72
251408
6346
04:33
and you know that over three quarters of all of those cases
73
257754
3661
04:37
of exoneration involved only eyewitness identification
74
261415
6271
04:43
testimony during the trial that convicted them.
75
267686
3647
durante os julgamentos que condenaram os suspeitos.
04:47
We know that eyewitness identifications are fallible.
76
271333
5175
04:52
The other comes from an interesting aspect
77
276508
2220
Outra questão vem de um aspecto interessante
04:54
of human memory that's related to various brain functions
78
278728
3203
04:57
but I can sum up for the sake of brevity here
79
281931
2566
mas, para ser breve, posso resumir aqui
05:00
in a simple line:
80
284497
2384
em uma simples linha:
05:02
The brain abhors a vacuum.
81
286881
4748
O cérebro abomina o vácuo.
05:07
Under the best of observation conditions,
82
291629
3910
Na melhor das condições de observação,
05:11
the absolute best,
83
295539
1872
o melhor absoluto,
05:13
we only detect, encode and store in our brains
84
297411
3713
nós somente detectamos, codificamos e guardamos em nossos cérebros
05:17
bits and pieces of the entire experience in front of us,
85
301124
3695
pedaços da experiência completa na nossa frente,
05:20
and they're stored in different parts of the brain.
86
304819
2329
05:23
So now, when it's important for us to be able to recall
87
307148
4155
05:27
what it was that we experienced,
88
311303
3021
o que experienciamos,
05:30
we have an incomplete, we have a partial store,
89
314324
5278
temos um arquivo incompleto, parcial,
05:35
and what happens?
90
319602
2453
e o que acontece?
05:37
Below awareness, with no requirement for any kind of
91
322055
2824
Inconscientemente, sem nenhum tipo de
05:40
motivated processing, the brain fills in information
92
324879
5171
processamento deliberado, o cérebro completa a informação
05:45
that was not there,
93
330050
2425
que não estava lá,
05:48
not originally stored,
94
332475
2450
que não tinha sido originalmente armazenada,
05:50
from inference, from speculation,
95
334925
2544
por inferência, por especulação,
05:53
from sources of information that came to you,
96
337469
2812
05:56
as the observer, after the observation.
97
340281
3135
como observador, depois da observação.
05:59
But it happens without awareness such that
98
343416
2074
Mas isto acontece tão inconscientemente
06:01
you don't, aren't even cognizant of it occurring.
99
345490
3634
06:05
It's called reconstructed memories.
100
349124
2267
É o que chamamos de memórias reconstruídas.
06:07
It happens to us in all the aspects of our life, all the time.
101
351391
4299
06:11
It was those two considerations, among others --
102
355690
3264
Foram aquelas duas considerações, entre outras --
06:14
reconstructed memory, the fact about the eyewitness fallibility --
103
358954
4505
06:19
that was part of the instigation
104
363459
3056
que foram parte da instigação
06:22
for a group of appeal attorneys
105
366515
2449
para um grupo de advogados de apelação,
06:24
led by an amazing lawyer named Ellen Eggers
106
368964
3472
06:28
to pool their experience and their talents together
107
372436
4128
que reuniram suas experiências e seus talentos
06:32
and petition a superior court
108
376564
1837
para solicitar a um tribunal superior
06:34
for a retrial for Francisco Carrillo.
109
378401
5070
um novo julgamento para Francisco Carrillo.
06:39
They retained me, as a forensic neurophysiologist,
110
383471
4388
Eles me contrataram, como neurofisiologista forense,
06:43
because I had expertise
111
387859
2142
porque eu tinha conhecimento
06:45
in eyewitness memory identification,
112
390001
2120
na identificação das memórias de testemunhas oculares,
06:48
which obviously makes sense for this case, right?
113
392121
3195
o que obviamente faz sentido neste caso, certo?
06:51
But also because I have expertise and testify about
114
395316
3344
06:54
the nature of human night vision.
115
398660
4377
a natureza da visão humana noturna.
06:58
Well, what's that got to do with this?
116
403037
3033
Bem, o que uma coisa tem a ver com a outra?
07:01
Well, when you read through the case materials
117
406070
3302
07:05
in this Carrillo case,
118
409372
2722
Carrillo,
07:07
one of the things that suddenly strikes you is that
119
412094
2830
07:10
the investigating officers said the lighting was good
120
414924
3490
07:14
at the crime scene, at the shooting.
121
418414
3534
na cena do crime, no tiroteio.
07:17
All the teenagers testified during the trial
122
421948
3457
Todos os adolescentes testemunharam durante o julgamento
07:21
that they could see very well.
123
425405
3479
que eles podiam ver muito bem.
07:24
But this occurred in mid-January,
124
428884
2840
Mas isto aconteceu no meio de janeiro,
07:27
in the Northern Hemisphere, at 7 p.m. at night.
125
431724
5999
no hemisfério Norte, às 7 horas da noite.
07:33
So when I did the calculations
126
437723
3025
Então, quando eu fiz os cálculos
07:36
for the lunar data and the solar data
127
440748
2212
para os dados lunares e solares
07:38
at that location on Earth at the time of the incident
128
442960
3179
naquela localidade na Terra, na hora do incidente
07:42
of the shooting, all right,
129
446139
2048
dos disparos, certo,
07:44
it was well past the end of civil twilight
130
448187
2617
já tinha passado o fim do crepúsculo
07:46
and there was no moon up that night.
131
450804
2256
e não havia lua naquela noite.
07:48
So all the light in this area from the sun and the moon
132
453060
2279
Então toda a luz naquela área, do sol e da lua,
07:51
is what you see on the screen right here.
133
455339
2584
07:53
The only lighting in that area had to come
134
457923
2914
A única claridade naquela área tinha que vir
07:56
from artificial sources,
135
460837
3270
de fontes artificiais,
08:00
and that's where I go out and I do the actual reconstruction
136
464107
2768
e é aí que eu saio e faço a reconstrução
08:02
of the scene with photometers, with various measures
137
466875
2797
da cena com fotômetros, com várias medidas
08:05
of illumination and various other measures of
138
469672
1974
de iluminação e várias outras medidas de
08:07
color perception, along with special cameras
139
471646
4467
percepção de cor, com câmeras especiais
08:12
and high-speed film, right?
140
476113
2129
e filmes de alta velocidade, certo?
08:14
Take all the measurements and record them, right?
141
478242
2929
Pego todas as medidas e as registro, certo?
08:17
And then take photographs, and this is what the scene
142
481171
2157
E então tiro fotografias, e assim estava a cena
08:19
looked like at the time of the shooting
143
483328
1435
no momento dos disparos,
08:20
from the position of the teenagers
144
484763
2466
da posição em que os adolescentes viram
08:23
looking at the car going by and shooting.
145
487229
3822
o carro passando e disparando.
08:26
This is looking directly across the street
146
491051
2305
08:29
from where they were standing.
147
493356
2328
de onde eles estavam parados.
08:31
Remember, the investigating officers' report said
148
495684
2353
08:33
the lighting was good.
149
498037
2233
que a luz era boa.
08:36
The teenagers said they could see very well.
150
500270
2434
08:38
This is looking down to the east,
151
502704
3251
Esta é a visão para o leste,
08:41
where the shooting vehicle sped off,
152
505955
3696
onde o veículo que disparou acelerou,
08:45
and this is the lighting directly behind the father
153
509651
4892
e esta é a luz direta atrás do pai
08:50
and the teenagers.
154
514543
2341
e dos adolescentes.
08:52
As you can see, it is at best poor.
155
516884
3911
Como vocês podem ver, é muito pobre.
08:56
No one's going to call this well-lit, good lighting,
156
520795
3873
Ninguém diria que é uma boa iluminação,
09:00
and in fact, as nice as these pictures are,
157
524668
3194
09:03
and the reason we take them is I knew I was going to have to testify in court,
158
527862
3461
09:07
and a picture is worth more than a thousand words
159
531323
3192
09:10
when you're trying to communicate numbers,
160
534515
2400
quando você está tentando comunicar números,
09:12
abstract concepts like lux, the international measurement
161
536915
3272
conceitos abstratos como lux, a medida internacional
09:16
of illumination, the Ishihara color perception test values.
162
540187
5176
09:21
When you present those to people who are not well-versed
163
545363
3161
09:24
in those aspects of science and that, they become
164
548524
3116
naqueles aspectos da ciência, elas se tornam
09:27
salamanders in the noonday sun. It's like
165
551640
2379
salamandras ao sol do meio-dia. É como
09:29
talking about the tangent of the visual angle, all right?
166
554019
2914
falar sobre a tangente do ângulo visual, certo?
09:32
Their eyes just glaze over, all right?
167
556933
2785
Os olhos delas ficam vidrados, certo?
09:35
A good forensic expert also has to be a good educator,
168
559718
4359
09:39
a good communicator, and that's part of the reason
169
564077
2159
09:42
why we take the pictures, to show not only
170
566236
2295
09:44
where the light sources are, and what we call the spill,
171
568531
2800
09:47
the distribution, but also so that it's easier
172
571331
2629
09:49
for the trier of fact to understand the circumstances.
173
573960
4035
para o juiz compreender as circunstâncias.
09:53
So these are some of the pictures that, in fact,
174
577995
2873
Então estas são algumas das fotos que
09:56
I used when I testified,
175
580868
2415
eu usei quando testemunhei,
09:59
but more importantly were, to me as a scientist,
176
583283
1865
10:01
are those readings, the photometer readings,
177
585148
1983
aquelas leituras do fotômetro,
10:03
which I can then convert into actual predictions
178
587131
4600
que eu posso converter em predições reais
10:07
of the visual capability of the human eye
179
591731
3520
da capacidade visual do olho humano
10:11
under those circumstances,
180
595251
2376
naquelas circunstâncias,
10:13
and from my readings that I recorded at the scene
181
597627
3648
e das leituras que gravei na cena,
10:17
under the same solar and lunar conditions
182
601275
2240
sob as mesmas condições solares e lunares,
10:19
at the same time, so on and so forth, right,
183
603515
2992
ao mesmo tempo etc. e tal,
10:22
I could predict
184
606507
1406
eu pude prever
10:23
that there would be no reliable color perception,
185
607913
2192
10:26
which is crucial for face recognition,
186
610105
2314
10:28
and that there would be only scotopic vision,
187
612419
2312
e que poderia haver apenas visão escotópica,
10:30
which means there would be very little resolution,
188
614731
1960
o que significa que haveria pouquíssima resolução,
10:32
what we call boundary or edge detection,
189
616691
2248
10:34
and that furthermore, because the eyes would have been
190
618939
2315
e, além disso, como os olhos estariam
10:37
totally dilated under this light, the depth of field,
191
621254
3805
10:40
the distance at which you can focus and see details,
192
625059
3158
10:44
would have been less than 18 inches away.
193
628217
5394
teria sido menor que 46 centímetros.
10:49
I testified to that to the court,
194
633611
2504
Eu testemunhei isto no tribunal,
10:52
and while the judge was very attentive,
195
636115
2433
e o juiz estava muito atento –
10:54
it had been a very, very long hearing
196
638548
2607
foi uma longa audiência
10:57
for this petition for a retrial, and as a result,
197
641155
4744
11:01
I noticed out of the corner of my eye
198
645899
1760
eu percebi, com o canto do olho,
11:03
that I thought that maybe the judge was going to need
199
647659
4145
que talvez o juiz precisasse
11:07
a little more of a nudge
200
651804
2063
de um empurrãozinho
11:09
than just more numbers.
201
653867
2508
além de apenas mais números.
11:12
And here I became a bit audacious,
202
656375
2292
E aqui eu fui um pouco audacioso,
11:14
and I turned
203
658667
1520
me virei
11:16
and I asked the judge,
204
660187
2392
e perguntei ao juiz:
11:18
I said, "Your Honor, I think you should go out
205
662579
2408
"Meritíssimo, eu penso que o Sr. deveria sair
11:20
and look at the scene yourself."
206
664987
2704
e olhar a cena por si mesmo."
11:23
Now I may have used a tone which was more like a dare
207
667691
3141
11:26
than a request — (Laughter) —
208
670832
2404
do que uma solicitação - (Risos) -
11:29
but nonetheless, it's to this man's credit and his courage
209
673236
4447
11:33
that he said, "Yes, I will."
210
677683
3616
ele disse: "Sim, eu vou."
11:37
A shocker in American jurisprudence.
211
681299
3992
Uma história comovente na jurisprudência americana.
11:41
So in fact, we found the same identical conditions,
212
685291
2472
Então, de fato, nós encontramos as mesmas condições,
11:43
we reconstructed the entire thing again,
213
687763
2041
reconstruímos a coisa toda de novo,
11:45
he came out with an entire brigade of sheriff's officers
214
689804
4010
11:49
to protect him in this community, all right? (Laughter)
215
693814
5157
para protegê-lo nesta comunidade, certo? (Risos)
11:54
We had him stand actually slightly in the street,
216
698971
5054
11:59
so closer to the suspect vehicle, the shooter vehicle,
217
704025
3180
do veículo suspeito, o veículo do atirador,
12:03
than the actual teenagers were,
218
707205
2742
do que os adolescentes estavam,
12:05
so he stood a few feet from the curb
219
709947
2224
então ele permaneceu a poucos centímetros do meio-fio,
12:08
toward the middle of the street.
220
712171
2612
em direção ao meio da rua.
12:10
We had a car that came by,
221
714783
2917
Nós tinhamos um carro que vinha,
12:13
same identical car as described by the teenagers, right?
222
717700
4951
12:18
It had a driver and a passenger,
223
722651
1937
Ele tinha um motorista e um passageiro,
12:20
and after the car had passed the judge by,
224
724588
3823
12:24
the passenger extended his hand,
225
728411
3514
o passageiro estendeu sua mão,
12:27
pointed it back to the judge as the car continued on,
226
731925
4574
12:32
just as the teenagers had described it, right?
227
736499
2219
exatamente como os adolescentes tinham descrito, certo?
12:34
Now, he didn't use a real gun in his hand,
228
738718
2853
12:37
so he had a black object in his hand that was similar
229
741571
2418
12:39
to the gun that was described.
230
743989
1979
à arma que tinha sido descrita.
12:41
He pointed by, and this is what the judge saw.
231
745968
2846
12:44
This is the car 30 feet away from the judge.
232
748814
7099
Este é o carro 10 metros distante do juiz.
12:51
There's an arm sticking out of the passenger side
233
755913
2912
12:54
and pointed back at you.
234
758825
2373
e apontando para você.
12:57
That's 30 feet away.
235
761198
1965
Isto é a 10 metros de distância.
12:59
Some of the teenagers said that in fact the car
236
763163
2192
13:01
was 15 feet away when it shot.
237
765355
2576
13:03
Okay. There's 15 feet.
238
767931
3664
Ok. Aqui está: 5 metros.
13:07
At this point, I became a little concerned.
239
771595
4170
Neste ponto, eu fiquei um pouco preocupado.
13:11
This judge is someone you'd never want to play poker with.
240
775765
4734
13:16
He was totally stoic. I couldn't see a twitch of his eyebrow.
241
780499
4288
Ele estava totalmente indiferente.
13:20
I couldn't see the slightest bend of his head.
242
784787
3269
13:23
I had no sense of how he was reacting to this,
243
788056
3501
13:27
and after he looked at this reenactment,
244
791557
3040
e, depois que ele observou a reconstituição,
13:30
he turned to me and he says,
245
794597
1080
ele se voltou para mim e disse:
13:31
"Is there anything else you want me to look at?"
246
795677
3258
"Tem mais alguma coisa que você quer que eu veja?"
13:34
I said, "Your honor," and I don't know whether I was
247
798935
4495
13:39
emboldened by the scientific measurements that I had
248
803430
2957
entusiasmado pelas medições científicas que eu tinha
13:42
in my pocket and my knowledge that they are accurate,
249
806387
3696
13:45
or whether it was just sheer stupidity,
250
810083
2255
ou se foi somente pura estupidez,
13:48
which is what the defense lawyers thought — (Laughter) —
251
812338
2825
13:51
when they heard me say,
252
815163
1752
quando eles me ouviram dizer:
13:52
"Yes, Your Honor, I want you stand right there
253
816915
2704
"Sim, Meritíssimo, eu quero que o Sr. fique bem aqui,
13:55
and I want the car to go around the block again
254
819619
4336
13:59
and I want it to come and I want it to stop
255
823955
3354
volte e pare
14:03
right in front of you, three to four feet away,
256
827309
4190
14:07
and I want the passenger to extend his hand
257
831499
3456
14:10
with a black object and point it right at you,
258
834955
2016
14:12
and you can look at it as long as you want."
259
836971
5720
14:18
And that's what he saw. (Laughter)
260
842691
4427
E isto é o que ele viu. (Risos)
14:23
You'll notice, which was also in my test report,
261
847118
3840
14:26
all the dominant lighting is coming from the north side,
262
850958
2645
que toda a luz dominante está vindo do lado norte,
14:29
which means that the shooter's face would
263
853603
1743
o que significa que o rosto do atirador
14:31
have been photo-occluded. It would have been backlit.
264
855346
2616
estaria na sombra. Ele estaria na contraluz.
14:33
Furthermore, the roof of the car
265
857962
1902
Além disso, o teto do carro
14:35
is causing what we call a shadow cloud inside the car
266
859864
4274
14:40
which is making it darker.
267
864138
3330
o que o torna mais escuro.
14:43
And this is three to four feet away.
268
867468
4112
14:47
Why did I take the risk?
269
871580
3128
Por que eu corri o risco?
14:50
I knew that the depth of field was 18 inches or less.
270
874708
4229
14:54
Three to four feet, it might as well have been
271
878937
1667
14:56
a football field away.
272
880604
4472
a um campo de futebol de distância.
15:00
This is what he saw.
273
885076
2208
Isto é o que ele viu.
15:03
He went back, there was a few more days of evidence
274
887284
3800
15:06
that was heard. At the end of it,
275
891084
2304
que foram ouvidas. No final,
15:09
he made the judgment that he was going to grant
276
893388
2628
ele sentenciou que iria conceder
15:11
the petition for a retrial.
277
896016
3078
a petição para um novo julgamento.
15:14
And furthermore, he released Mr. Carrillo
278
899094
2478
E além disso, ele libertou o Sr. Carrillo
15:17
so that he could aid in the preparation of his own defense
279
901572
2987
15:20
if the prosecution decided to retry him.
280
904559
6019
se o promotor decidisse julgá-lo novamente.
15:26
Which they decided not to.
281
910578
2310
O que eles decidiram não fazer.
15:28
He is now a freed man. (Applause)
282
912888
5061
Ele agora é um homem livre. (Aplausos)
15:33
(Applause)
283
917949
3943
(Aplausos)
15:37
This is him embracing his grandmother-in-law.
284
921892
5104
15:42
He -- His girlfriend was pregnant when he went to trial,
285
926996
4075
15:46
right? And she had a little baby boy.
286
931071
4085
certo? E ela teve um menino.
15:51
He and his son are both attending Cal State, Long Beach
287
935156
2681
Ele e seu filho estão agora estudando na Cal State Long Beach.
15:53
right now taking classes. (Applause)
288
937837
6188
(Aplausos)
15:59
And what does this example --
289
944025
3963
E o que este exemplo –
16:03
what's important to keep in mind for ourselves?
290
947988
4344
16:08
First of all, there's a long history of antipathy
291
952332
3696
16:11
between science and the law
292
956028
2080
entre a ciência e a lei
16:14
in American jurisprudence.
293
958108
2400
na jurisprudência americana.
16:16
I could regale you with horror stories of ignorance
294
960508
3448
16:19
over decades of experience as a forensic expert
295
963956
4336
16:24
of just trying to get science into the courtroom.
296
968292
4506
tentando levar a ciência para dentro do tribunal.
16:28
The opposing council always fight it and oppose it.
297
972798
4934
16:33
One suggestion is that all of us become much more
298
977732
3387
16:37
attuned to the necessity, through policy,
299
981119
2869
sintonizados à necessidade, através da política,
16:39
through procedures,
300
983988
2056
através dos procedimentos,
16:41
to get more science in the courtroom,
301
986044
3184
de se ter mais ciência nos tribunais,
16:45
and I think one large step toward that
302
989228
2311
