02:10
I now call it "digital domestic violence."
36

Chamo de "violência doméstica digital".
02:14
It typically stems from

Vem geralmente de um relacionamento

02:37
I mean, let's face it --
we all live our lives online.
44
145082
3241
Vamos encarar: todos nós
vivemos nossa vida on-line.
E a internet é um mundo muito pequeno.
02:40
And the internet is a really small world.
45
148347
2754
Exibimos fotos de nossos filhos,
02:43
We show off our baby photos,
46
151125

desenvolvemos nossos negócios,
criamos novos relacionamentos,
02:45
we start and grow our businesses,
we make new relationships,
47
153014
2833
deixamos o mundo entrar,
uma curtida de Facebook por vez.
02:47
we let the world in,
one Facebook like at a time.
48
155871
4716
02:53
And you know what I found?
49
161323
1516
E sabem o que descobri?
Um mundo ainda menor.
02:54
An even smaller world.
50
162863

02:56
One in 25 women say
they have been impacted by revenge porn.
51
164728
4214
Uma em cada 25 mulheres diz ter sido
impactada por pornografia de vingança.
03:01
For women under the age of 30,
that number looks like one in 10.
52
169395
4143
Para mulheres com menos de 30 anos,
esse número parece 1 em 10.
Isso faz de algumas de vocês
na plateia possíveis vítimas.
03:06
And that leaves a few of you
in this audience as potential victims.
53
174186
3933
03:10
You want to know
what's even more alarming?
54
178630
2103
Querem saber o que é ainda mais alarmante?
A falta de legislação e leis para proteger
as vítimas de maneira adequada
03:12
Lack of legislation and laws
to adequately protect victims
55
180757
3998
e punir quem comete esses crimes.
03:16
and punish perpetrators.
56
184779
1560
03:18
There's only one federal bill pending;
57
186363
2373
Há apenas um projeto de lei
federal pendente.
Chama-se decreto ENOUGH,
da senadora Kamala Harris.
03:20
it's called the ENOUGH Act,
by Senator Kamala Harris.
58
188760
3117
03:24
It would criminalize revenge porn.
59
192712
2705
Esse decreto criminalizaria
a pornografia de vingança.
03:27
But that could take years to pass.
60
195441
2175
Mas pode levar anos para ser promulgado.
03:29
So what are we left with in the meantime?
61
197640
2030
Então, como ficamos nesse meio-tempo?
03:31
Flimsy civil misdemeanors.
62
199694
1930
Contravenções civis frágeis.
03:33
Currently, only 40 states and DC
have some laws in place for revenge porn.
63
201648
6484
Atualmente, apenas 40 estados
e o distrito de Columbia
têm algumas leis em vigor
para a pornografia de vingança.
As multas variam.
03:40
And those penalties vary --
we're talking $500 fines.
64
208156
3881
Estamos falando de multas de US$ 500.
03:44
Five hundred dollars?
65
212061
1203
Quinhentos dólares?
03:45
Are you kidding me?
66
213288
1153
Estão brincando?
As mulheres estão perdendo o emprego,
03:46
Women are losing their jobs.
67
214465
1356
03:47
They're suffering
from damaged relationships
68
215845
2307
sofrendo com relacionamentos
e reputações prejudicadas.
03:50
and damaged reputations.
69
218176
1361
03:51
They're falling into illness
and depression.
70
219561
2540
Estão ficando doentes e deprimidas.
E as taxas de suicídio estão subindo.
03:54
And the suicide rates are climbing.
71
222125
2488
03:57
You're looking at a woman
who spent 11 months in court,
72
225802
4190
Vocês estão olhando para uma mulher
que passou 11 meses no tribunal,
fez 13 viagens ao tribunal
04:02
thirteen trips to the courthouse
73
230016
2127
e gastou milhares de dólares
em taxas jurídicas,
04:04
and thousands of dollars in legal fees,
74
232167
2466
só para conseguir duas coisas:
04:06
just to get two things:
75
234657
1634
proteção contra perseguição
e abuso cibernéticos,
04:08
a protection from cyberstalking
and cyberabuse,
76
236315
2897
também conhecida como PFA,
04:11
otherwise known as a PFA,
77
239236
2476
e linguagem de um juiz
04:13
and language from a judge
78
241736
1242
que forçava uma empresa de internet
de terceiros a remover o conteúdo.
04:15
that would force a third-party
internet company
79
243002
2258
04:17
to remove the content.
80
245284
1598
04:19
It's expensive, complicated and confusing.
81
247815
3185
É caro, complicado e confuso
04:23
And worse, legal loopholes
and jurisdictional issues drag this out
82
251024
5446
e pior:
brechas jurídicas e assuntos
jurisdicionais duram meses,
04:28
for months,
83
256494
1284
04:29
while my private parts
were on display for months.
84
257802
3839
enquanto minhas partes íntimas
estavam sendo exibidas há meses.
Como você se sentiria se seu corpo nu
estivesse exposto para o mundo ver,
04:34
How would you feel if your naked body
was exposed for the world to see,
85
262203
4032
04:38
and you waited helplessly
for the content to be removed?
86
266259
3306
e você esperasse sem poder fazer nada
que o conteúdo fosse removido?
04:42
Eventually, I stumbled upon
a private company
87
270966
2667
Por fim, encontrei por acaso
uma empresa privada
04:45
to issue a DMCA notice
to shut the website down.
88
273657
3128
para emitir um aviso DMCA
para fechar o site.
DMCA - Digital Millennium Copyright Act.
04:49
DMCA -- Digital Millennium Copyright Act.
89
277434
3383
É uma lei que regula
conteúdo e material digital.
04:53
It's a law that regulates
digital material and content.
90
281154
3115
De modo geral, o objetivo do DMCA
04:56
Broadly, the aim of the DMCA is to protect
both copyright owners and consumers.
91
284582
5048
é proteger proprietários e consumidores
de direitos autorais.
05:01
So get this:
92
289654
1162
Entendam isto:
as pessoas que tiram e compartilham
fotos de nudez têm os direitos delas.
05:02
people who take and share nude photos
own the rights to those selfies,
93
290840
5036
05:07
so they should be able to issue a DMCA
to have the content removed.
94
295900
4952
Então, elas deveriam poder emitir um DMCA
para ter o conteúdo removido.
Mas não tão rápido,
05:12
But not so fast --
95
300876
1337
pois a outra batalha que estamos travando
05:14
because the other fight we're dealing with
96
302237
2412
05:16
is noncompliant and nonresponsive
third-party internet companies.
97
304673
4333
são empresas de internet de terceiros
não conformes e não receptivas.
A propósito,
05:21
And oh -- by the way,
98
309030
1702
mesmo em relacionamentos
com consentimento,
05:22
even in consenting relationships,
99
310756
2123
05:24
just because you get
a nude photo or a naked pic,
100
312903
3349
só porque você consegue uma foto de nudez,
isso não lhe dá o direito
de compartilhá-la,
05:28
does not give you the right to share it,
101
316276
2252
05:31
even [without] the intent to do harm.
102
319053
2134
mesmo sem a intenção de fazer mal.
05:34
Back to my case,
103
322157
1625
De volta ao meu caso,
que é ainda mais complicado,
05:35
which happens to be further complicated
104
323806
1953
porque ele estava me perseguindo
e assediando de outro país,
05:37
because he was stalking and harassing me
from another country,
105
325783
3167
05:40
making it nearly impossible
to get help here.
106
328974
3966
tornando quase impossível
conseguir ajuda aqui.
05:45
But wait a minute --
isn't the internet international?
107
333441
2993
Mas, espere um pouco:
a internet não é internacional?
Não deveríamos ter alguma
espécie de política em vigor
05:48
Shouldn't we have
some sort of policy in place
108
336458
2468
05:50
that broadly protects us,
regardless to borders or restrictions?
109
338950
3860
que, de modo geral, nos proteja
independentemente
de fronteiras ou restrições?
05:55
I just couldn’t give up;
I had to keep fighting.
110
343800
2864
Eu não podia desistir;
tinha que continuar lutando.
05:59
So I willingly, on three occasions,
111
347149
3587
Então eu prontamente, em três ocasiões,
permiti a invasão de meu celular e laptop
06:02
allowed for the invasion
of both my cell phone and my laptop
112
350760
4539
pelo Departamento de Segurança Interna
e pela embaixada jamaicana
06:07
by the Department of Homeland Security
and the Jamaican Embassy
113
355323
3960
para investigação forense completa,
06:11
for thorough forensic investigation,
114
359307
2222
06:13
because I had maintained
all of the evidence.
115
361553
2746
porque eu havia mantido
todas as evidências.
06:17
I painstakingly shared my private parts
with the all-male investigative team.
116
365680
5278
Compartilhei minhas partes íntimas
com a equipe masculina de investigação.
06:23
And it was an embarrassing, humiliating
additional hoop to jump through.
117
371735
4317
Foi mais uma situação embaraçosa
e humilhante para enfrentar.
06:29
But then something happened.
118
377315
1802
Mas, então, algo aconteceu.
06:31
Jamaican authorities
actually arrested him.
119
379982
2934
As autoridades jamaicanas,
na verdade, o prenderam.
06:35
He's now facing charges
under their malicious communications act,
120
383562
4838
Agora ele enfrenta acusações
em virtude da lei de comunicações
maliciosas da Jamaica,
06:40
and if found guilty, could face
thousands of dollars in fines
121
388424
4293
e, se for considerado culpado, deverá
pagar milhares de dólares em multas
06:44
and up to 10 years in prison.
122
392741
1912
e passar até dez anos na prisão.
Descobri também que meu caso
está fazendo história:
06:46
And I've also learned that my case
is making history --
123
394677
2599
é o primeiro caso internacional
desse novo crime.
06:49
it is the first international case
under this new crime.
124
397300
4555
Uau, finalmente alguma justiça.
06:54
Wow, finally some justice.
125
402595
3654
Mas isso me levou a pensar.
06:58
But this got me to thinking.
126
406273
2079
07:00
Nobody deserves this.
127
408376
2074
Ninguém merece isso.
07:02
Nobody deserves this level of humiliation
128
410474
3587
Ninguém merece esse nível de humilhação
e ter que passar por tudo isso.
07:06
and having to jump through
all of these hoops.
129
414085
3683
07:10
Our cyber civil rights are at stake.
130
418506
3801
Nossos direitos civis
cibernéticos estão em jogo.
07:14
Here in the United States,
we need to have clear, tough enforcement;
131
422331
4872
Aqui nos Estados Unidos, precisamos ter
um cumprimento claro e severo da lei;
07:19
we need to demand the accountability
and responsiveness from online companies;
132
427227
4856
precisamos exigir a prestação de contas
e a receptividade de empresas on-line;
precisamos promover
responsabilidade social
07:24
we need to promote social responsibilities
for posting, sharing and texting;
133
432107
4666
para publicar, compartilhar

07:28
and we need to restore dignity to victims.
134
436797
4119
e precisamos restaurar
a dignidade para as vítimas.
07:33
And what about victims
135
441506
1696
E quanto às vítimas,
que nunca têm tempo, dinheiro
e recursos para travar uma guerra,
07:36
who neither have the time,
money or resources to wage war,
136
444210
3462
que são deixadas sem poder,
rotuladas incorretamente e destruídas?
07:39
who are left disempowered,
mislabeled and broken?
137
447696
3981
07:44
Two things:
138
452362
1150
Duas coisas:
07:46
release the shame and end the silence.
139
454805
2534
libere a vergonha e acabe com o silêncio.
07:50
Shame is at the core of all of this.
140
458212
2803
A vergonha está no centro de tudo isso.
07:53
And for every silent prisoner of shame,
141
461474
3429
Para todo prisioneiro
silencioso da vergonha,
é o medo do julgamento que o faz refém.
07:56
it's the fear of judgment
that's holding you hostage.
142
464927
3079
08:00
And the price to pay
is the stripping away of your self-worth.
143
468030
3802
O preço a pagar é o despojamento
de sua autoestima.
08:05
The day I ended my silence,
I freed myself from shame.
144
473045
3971
No dia em que acabei com meu silêncio,
eu me libertei da vergonha.
08:09
And I freed myself
from the fear of judgment
145
477593
3183
Eu me libertei
do medo do julgamento da pessoa
que eu achava que mais me julgaria:
08:12
from the one person who I thought
would judge me the most --
146
480800
2880
08:16
my son,
147
484109
1150
meu filho,
08:17
who actually told me,
148
485847
1992
que, na verdade, me disse:
08:19
"Mom, you are the strongest
person that I know.
149
487863
3873
"Mãe, você é a pessoa
mais forte que conheço.
08:24
You can get through this.
150
492117
1667
Você pode superar isso.
08:26
And besides, mom -- he chose
the wrong woman to mess with."
151
494427
4737
Além disso, mãe, ele mexeu
com a pessoa errada".
08:31
(Laughter)
152
499188
1716
(Risos)
(Aplausos)
08:32
(Applause)
153
500928
4616
08:37
It was on that day that I decided
to use my platform
154
505568
3694
Foi naquele dia que decidi
usar minha plataforma,
minha história e minha voz.
08:41
and my story and my voice.
155
509286
2499
08:44
And to get started, I asked myself
this one simple question:
156
512633
3397
Para começar, fiz a mim mesma
uma simples pergunta:
08:48
Who do I need to become now?
157
516054
2100
"Quem eu preciso me tornar agora?"
08:50
That question, in the face of everything
that I was challenged with,
158
518784
4111
Essa pergunta, apesar de ter que lidar
com tudo a que fui desafiada,
08:54
transformed my life and had me thinking
about all kinds of possibilities.
159
522919
4253
transformou minha vida e me fez pensar
em todas as possibilidades.
Agora sou dona de minha história,
falo minha verdade
08:59
I now own my story, I speak my truth,
160
527196
3262
e estou contando um novo
capítulo de minha vida.
09:02
and I'm narrating
a new chapter in my life.
161
530482
2603
09:05
It's called "50 Shades of Silence."
162
533109
3218
Chama-se "50 Shades of Silence".
É um projeto de justiça social global,
09:08
It's a global social justice project,
163
536712
2579
e estamos trabalhando para filmar
um novo documentário
09:11
and we're working to film
an upcoming documentary
164
539315
2334
09:13
to give voice and dignity to victims.
165
541673
2466
para dar voz e dignidade às vítimas.
09:16
If you are a victim or you know
someone who is, know this:
166
544871
3667
Se você for vítima ou souber
de alguém que seja, saiba de uma coisa:
09:21
in order to be empowered,
you have to take care of yourself,
167
549101
3524
para se fortalecer, você tem
que cuidar de si mesmo,
09:24
and you have to love yourself.
168
552649
1706
e amar a si mesmo.
09:26
You have to turn your anger into action,
169
554379
2738
Você tem que transformar
sua raiva em ação,
09:29
your pain into power
170
557141
1563
sua dor em força
e seu contratempo em uma organização
para o que vem a seguir em sua vida.
09:30
and your setback into a setup
for what's next for your life.
171
558728
4440
09:36
This is a process, and it's a journey
of self-discovery
172
564309
3738
É um processo e uma jornada
de autodescoberta
09:40
that might include forgiveness.
173
568071
2302
que pode incluir o perdão.
Mas, com certeza, requer coragem,
confiança e convicção.
09:42
But it definitely requires bravery,
confidence and conviction.
174
570397
5121
09:48
I call it:
175
576136
1484
É o que eu chamo:
09:49
finding your everyday courage.
176
577644
3122
encontrar sua coragem diária.
09:54
Thank you.
177
582048
1159
Obrigada.
09:55
(Applause)
